Both Walmart and Loblaw have said they will not sign the code as currently drafted, warning that it could result in higher prices for Canadians.
Although this provision is voluntary, some are calling for it to become law to ensure that all industry participants sign it.
If any retailer decides not to participate in the code, its mandate will be undermined, the commission said.
Supporters of the code say it helps level the playing field for suppliers and small grocers.
