While the Apple Watch is back on the market, Apple’s patent dispute with medical device company Masimo is far from over.In a new interview with wall street journal, Masimo CEO Joe Chiani details why he is determined to fight Apple to the bitter end. If Apple can do that, it might change things for the better. ”
In an interview, Chiani said Masimo has spent about $100 million so far in its fight with Apple, which began in January 2020. WSJ Masimo’s 2022 gross profit was approximately $144 million, it notes.
Before taking on Apple, Masimo employees and Kiani’s friends warned Kiani of the risks ahead. “People were saying I was crazy and that I couldn’t go against Apple,” Kiani said. “They have unlimited resources.”
The battle between Masimo and Apple will likely take years to end, but the company has won similar cases in the past.
In 2006, [Kiani] It won a seven-year patent battle with Nellcor, a leading provider of rival pulse oximeter devices at the time. In 2016, it defeated Royal Philips in another patent infringement case.
As part of the 2006 settlement with Nellcor, Masimo received approximately $800 million in damages and royalties. In a 2016 settlement with Royal Philips, the company paid Masimo $300 million and agreed to a licensing agreement that would net Masimo “more than $1 billion.”
Chiani said Apple has not yet engaged in “serious settlement discussions” with Masimo. In a previous interview, Mr. Chiani said that while Mr. Masimo was open to a settlement with Apple, “it takes two to tango.”
“I feel like I have to do this,” Kiani concluded. “If I can change the most powerful company in the world from continuing to misbehave, that will have a bigger impact on the world than anything else I do.”
